Terms of Service

1. Overview

These Terms of Service govern the tuition arrangements between TopScorerPlus ("we", "us", "the tutor") and the student or parent/guardian ("you", "the client") who engages our services. By booking a session, making a payment, or continuing to use our services, you agree to be bound by these terms.

TopScorerPlus is a private tuition service operated by Adrian Wong, providing online and home tuition in Mathematics and related subjects to secondary, IGCSE, Pre-University and university students.

2. Trial Session

New clients are entitled to one (1) free trial session before committing to a regular arrangement. The trial session is conducted at no charge and carries no obligation to continue. Only one free trial session is permitted per student.

3. Payment Terms

• Payment is due before the start of each billing cycle (monthly or bundle period). Sessions for the upcoming period will not be confirmed until payment is received.
• Accepted payment methods will be communicated by the tutor at the time of booking.
• Rates are subject to change with reasonable notice. Existing arrangements will be honoured until the end of the current billing cycle before any new rate takes effect.

4. Cancellation & Refund Policy

• You may cancel your tuition arrangement at any time without prior notice.
• Any fees paid for the current billing cycle (monthly or bundle) are non-refundable upon cancellation, as sessions within the paid period are reserved exclusively for the student.
• Partial or full refunds may be granted at the sole discretion of TopScorerPlus in circumstances deemed reasonable, including but not limited to prolonged illness, sudden relocation, or exceptional personal circumstances. Requests for refund consideration must be submitted in writing to adrianwong.topscorerplus@gmail.com .
• Refund decisions are final and will be communicated within 7 working days of the request.

5. Rescheduling

• Sessions may be rescheduled by either party, subject to the mutual availability of the tutor and student.
• Rescheduled sessions will be arranged at the earliest mutually convenient time within the same billing cycle where possible.
• Repeated last-minute rescheduling may affect the ability to accommodate alternative slots within the billing period.

6. Home Tuition (Physical Sessions)

• For home tuition sessions, a mileage/travel surcharge may apply depending on the distance from the tutor's base location. This will be communicated and agreed upon before the commencement of sessions.
• In the event that the tutor is unable to attend a physical session due to unforeseen circumstances (e.g. vehicle breakdown, road conditions, health issues), the session will be rescheduled at the earliest mutually available time. No additional charge will apply for rescheduled sessions under such circumstances.
• Clients are expected to provide a safe and conducive learning environment for home sessions.

7. Online Sessions

• Online sessions are conducted via Google Meet, Zoom, or another agreed platform.
• The student is responsible for ensuring a stable internet connection and a suitable device for the session.
• Recording of sessions is permitted by the student for personal study purposes only. Recordings must not be shared, published, or distributed to any third party without the explicit written consent of TopScorerPlus.
• In the event of technical issues on either side causing significant disruption, the session may be rescheduled or continued at a later time.

8. Learning Materials

• Learning materials, notes, and worksheets prepared by the tutor are provided as part of the tuition service at no additional cost in digital form.
• Where physical printed materials are required and provided by the tutor, a reasonable printing charge may apply. This will be communicated to the client in advance.
• All materials prepared by TopScorerPlus remain the intellectual property of the tutor and may not be reproduced, redistributed, or used commercially without written consent.

9. Conduct & Engagement

• Both parties agree to maintain a respectful and professional relationship throughout the tuition engagement.
• TopScorerPlus reserves the right to terminate the tuition arrangement if conduct from the student or parent/guardian is deemed inappropriate or disruptive, with any remaining sessions refunded at the tutor's discretion.
• Results are not guaranteed. While we are committed to delivering quality instruction, academic outcomes depend on multiple factors including student effort and consistency.

10. Governing Law

These Terms of Service are governed by the laws of Malaysia. Any disputes arising from these terms shall be subject to the jurisdiction of the Malaysian courts.
